Hardhat — Terms of Use

These terms are an agreement between you and us covering Hardhat, a job-site photo and reporting app for iOS. Hardhat has its own terms because it offers a subscription. By downloading or using Hardhat, you agree to them. If you do not agree, please do not use the app.

Hardhat is a documentation tool, not a legal or insurance service. The photos, stamps and PDF reports it produces are records you create. We do not certify, witness or verify them, and we make no guarantee that any third party — a client, an insurer, an adjuster or a court — will accept them as evidence. Date, time, location and compass values come from your device and are only as accurate as your device settings allow.

Subscriptions

Hardhat is free to download and includes a free allowance of reports each calendar month. Hardhat Pro is an optional auto-renewing subscription offered on a monthly or yearly basis, which removes the monthly report limit and unlocks report branding with your own logo, watermark-free reports, and location stamping.

Your data

Your jobs, photos and reports are stored on your device. Hardhat has no account, no server and no analytics — we never receive your photos or job records, and we cannot see, recover or restore them. If you choose to allow it, Hardhat also saves a copy of each job photo into your own Photos library so that your normal device backup includes it. Keep your own backup if the records matter to you: because we do not hold a copy, losing or wiping your device loses the data.

Acceptable use

You are responsible for what you photograph and for how you use the reports you produce. Do not use Hardhat to photograph people or property where you have no right to do so, and do not use it to create misleading records. You are responsible for complying with any laws, contracts or site rules that apply to photography and record-keeping on the sites you work on.

Availability and changes

We may update the app, and may change or discontinue features. If we materially change these terms we will update this page and the "last updated" date above.

No warranty and liability

Hardhat is provided "as is", without warranties of any kind. To the fullest extent permitted by law, we are not liable for any loss of data, loss of business, disputed claim, rejected insurance claim, or other indirect or consequential loss arising from your use of the app. Nothing in these terms limits liability that cannot be limited by law.
